Affiliate Marketing/ Brand Ambassador Program Terms and Conditions

1.   Enrollment in the Program

• To enroll in the Daniella Faye Modest Clothing Affiliate Marketing Program (the "Program"), you must complete and submit the online application. Acceptance into the Program is at our sole discretion and may be revoked at any time.

2.   Affiliate Responsibilities

• Promotion: As an affiliate, you agree to actively promote Daniella Faye Modest Clothing through your unique referral link or code provided by us.
• Compliance: Affiliates must comply with all applicable laws, rules, and regulations, including FTC guidelines on endorsements and testimonials.
• Content: You must present our brand in a positive light and refrain from any form of misrepresentation, false advertising, or unlawful conduct.

3.   Commission Structure

• Commission Rate: Affiliates will earn up to 10% commission on all qualifying sales made through their unique referral code.
• Payout Threshold: Commission payouts will be processed once you have reached the minimum payout threshold of $100.
• Payment Schedule: Payments are made on a quarterly basis, typically within 45-60 days of the end of the period.

4.   Referral Tracking

• All referrals are tracked via cookies set by the unique affiliate link or code. The standard cookie duration is 30 days. Sales must be completed within this period for commissions to be earned.

5.   Prohibited Activities

• Spam: Affiliates are prohibited from engaging in any form of unsolicited commercial email (spam) to promote their referral link.
• Inappropriate Content: Promotion on websites or channels that feature obscene, violent, or unlawful content is strictly prohibited.
• Trademark Bidding: Affiliates are not allowed to bid on Daniella Faye trademarked terms or variations thereof in any pay-per-click search engine.

6.   Termination

• Daniella Faye reserves the right to terminate any affiliate’s participation in the Program at any time for any reason, including but not limited to violation of these terms or fraudulent activity.
• Upon termination, all pending commissions will be forfeited.

7.   Modification of Terms

• Daniella Faye reserves the right to modify these terms and conditions at any time. Affiliates will be notified of any changes via email. Continued participation in the Program after such modifications shall constitute consent to the updated terms.

8.   Relationship of Parties

• Affiliates are independent contractors. Nothing in these terms shall create any partnership, joint venture, franchise, or employment relationship between Daniella Faye and the affiliate.

9.   Limitation of Liability

• Daniella Faye shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with this Program.

10.   Governing Law

• These terms and conditions shall be governed by and construed in accordance with the laws of the State of Israel and or Delaware (USA), without regard to its conflict of law principles.
